Terms of Service

Effective date: March 2026. These Terms apply to all apps and services published by Herding Labs.

1. Acceptance of Terms

By downloading, accessing, or using any Herding Labs app or service, you agree to these Terms. If you do not agree, do not use the services.

2. Who We Are

Herding Labs is an independent software studio. References to "we" or "Herding Labs" in these Terms mean Herding Labs and its operator(s).

3. Eligibility

You must be at least 13 years old to use the services. If you are using the services on behalf of an organization, you represent you have authority to bind that organization to these Terms.

4. The Services

Herding Labs provides mobile software tools for personal use. Features may be updated, modified, or discontinued at any time.

5. Subscriptions, Trials, and Billing

Some features may require a paid subscription. Subscriptions, renewals, cancellations, and billing are handled by Apples in-app purchase system (StoreKit) and are subject to Apples terms. Herding Labs does not receive your full payment card details.

6. Acceptable Use

You agree not to misuse the services. That includes attempting unauthorized access, interfering with app operation, using the services in ways that violate applicable law, or infringing the rights of others.

7. Your Content

You retain rights to content you provide through the services (for example: photos, notes, logs, and other entries). You grant Herding Labs a limited, non-exclusive license to process that content solely to operate, maintain, and improve the services and to provide support.

You represent that you have the rights necessary to provide any content you upload.

8. Third-Party Services

The services may rely on third-party providers (for example: Apple for billing and platform services, and AI providers for specific features). Third-party services are governed by their own terms and privacy policies.

9. Intellectual Property

All software, branding, text, and visual assets associated with Herding Labs are owned by Herding Labs or its licensors. These Terms grant you a limited, revocable, non-transferable license to use the services for personal, non-commercial use, unless a separate written agreement states otherwise.

10. Disclaimers

The services are provided on an "as is" and "as available" basis, without warranties of any kind to the fullest extent permitted by law.

Health and wellness disclaimer: Any tracking or health-related features in Herding Labs apps are tools only. They are not medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional for medical decisions.

11. Limitation of Liability

To the maximum extent permitted by law, Herding Labs is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, revenue, or profits arising from or related to your use of the services.

12. Termination

You may stop using the services at any time. Herding Labs may suspend or terminate access to the services if necessary to protect the services, comply with law, or enforce these Terms.

13. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will update the effective date and may provide additional notice in the app or on this site.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of laws principles.
